In general, unless licensed by OFAC, goods, services, or technology may NOT be exported, re-exported, sold or supplied, directly or indirectly, from the United States or by a U.S. person, wherever located, to Iran or the Government of Iran.

These regulations apply to:

2.???? All U.S. permanent residents (green card holders);


3.???? All U.S. citizen or U.S. permanent residents located outside the United States;


4.???? All U.S. incorporated entities and their foreign branches;


5.???? All foreign subsidiaries owned and controlled by U.S. companies;


6.???? All persons or entities within the United States.

These regulation apply to all U.S. persons mentioned above wherever located. Furthermore, a U.S. person may NOT export from the U.S. any goods, technology or services, if the person knows or has reason to know such items are intended specifically for supply, transshipment or re-exportation to Iran.

The United States government is absolutely and strictly enforcing these laws. There are various Iranians and Iranian-Americans being prosecuted criminally and civilly at the present time. In fact, the U.S. Department of Justice sought and obtained an enhancement of criminal and civil penalties of Iran sanctions from the U.S. Congress in October of 2007 to a maximum of 20 years per violation. Civil penalties were enhanced to the greater of $250,000 per transaction or twice the amount of the transaction.


Furthermore, most transactions related to Iran are prohibited by the Iranian Transactions Regulations (I.T.R.) unless licensed by the Office of Foreign Assets Control of the U.S. Department of Treasury. Sale of any personal or real property in Iran is prohibited unless a specific LICENSE is obtained prior to such a sale. This prohibition applies to any real property; whether acquired by gift, inherited property or acquired long before the enactment of Iran sanctions.

?U.S. persons, including foreign branches of U.S. depository institutions and trading companies, are prohibited from engaging in any transactions, including purchase, sale, transportation, swap, financing, or brokering transactions related to goods or services of Iranian origin or services owned or controlled by the Government of Iran.?

Also it should be noted that If an individual?s name is on any real property in Iran, you will need a specific license before you can sell the property. However, if there was a probate proceeding in Iran and you have inherited an interest in real property in Iran, you may not need a specific license, and may be qualified to use ?General License B? to receive the funds in the U.S.

Transactions ordinarily incident to travel to or from Iran are exempt and authorized. Included are payment of living expenses and acquisition of goods and services for personal use and arrangement or facilitation of such travel including air, sea or land voyages.

For relocating in Iran, taking (exporting) household and personal effects for family use are authorized if the articles have been actually used by said family members (not intended for use by others or for sale nor otherwise prohibited).

Bringing (importing) Iranian-origin household and personal effects for personal or family use of persons arriving in the United States are authorized, if such articles have been actually used abroad by such person or by other family members. They must not be intended for any other person, nor for sale, and must not be otherwise prohibited.

Personality: Does what he has to so he can survive. He is battle hardened and short-tempered so he doesn't take crap from anybody. He can be friendly if that is his intention and is hard to approach at times.

Story: He was raised by his aunt and uncle from age 2-14 then he set off on his own believing they weren't telling him everything about his parents. While he was on the streets, searching for answers as a young child three muggers approached him. They beat him down in a dark ally and started to search his pockets. Helio's eyes glowed dark purple and his muscles seemed to flex and rapidly grow. Black plates grew out of his skin and his veins turned light blue. His head turned into a dark helmet as he stood up slowly. His shadow was reformed into dark wings as the reality in his appearance twisted to his will. A demonic blade slowly grew out of his forearm and he ripped it out and slit the three muggers throats in one swing. He looked at his arms noticing the great power he now possessed. He went on a reckless frenzy killing everything he saw and soon the whole city, including his aunt and uncle, was nothing but ash and ruin. Suddenly he looked up and archangels fell from the heavens and flew past him. He turned surprised they didn't attack him and followed them from afar. Once they stopped they looked at the ground waiting for something. The ground melted as hot lava shot out next to the figures and demons from below crawled out of the hole. The war had begun... Over the years Helio became a bounty hunter, an outlaw, not finding his destined faction of the war. He simply has stayed at his condo and occasionally "cleans the streets" waiting for a job worth his time. He is now 21, a ten year anniversary for the Hell Vs heaven war kickoff.

He wasn't exactly overlooked these days, he was still famous/notorious for the destruction of one of the biggest cities in the world. It wasn't a particular job he was proud of...He was young, sloppy, and without reason then. At least now he had a reason...Money. He turned his head to his katana that would become a cursed blade when he transformed and he sharpened it. He wouldn't age anywhere past this date. Uranium-contaminated site yields wealth of information on microbes 10 feet under

University of California, Berkeley, scientists have sequenced nearly all the genes in an underground community of microbes at a contaminated uranium mill site in Rifle, Colo., providing information that could help scientists better manipulate the microbes that remediate heavy metal contamination or those that take up and store carbon from the atmosphere.

Each of the 150,000 genes from the sample was assigned to one of 80 different microbes in the soil, an unprecedented computational feat made possible by new genomic tools developed at UC Berkeley.

The findings could help improve clean-up at hundreds of sites around the United States where microbes are nurtured to convert toxic metals, including arsenic and mercury, into chemical forms that will not leech into aquifers and streams, the scientists said. It may be possible, for example, to add nutrients that would create the ideal mix of microbes to immobilize the metals, instead of just feeding all the microbes already present.

"In order to make this goal a reality, it is critical not to just detect the relevant genes in subsurface microorganisms, but to know enough about the lifestyles of the organisms with genes of interest so that manipulation of the system enriches specifically for that organism," said study leader Jill Banfield, UC Berkeley professor of earth and planetary science and of environmental science, policy and management.

The information in the genomes of the 80 microbes located 10 feet or more beneath the surface could also lead to improved methods for stimulating the uptake of carbon from the atmosphere by soil bacteria to reduce greenhouse gases.

"Our study turned upside down what we thought was happening at the bioremediation site," said lead author Kelly C. Wrighton, a UC Berkeley post-doctoral fellow who specializes in the physiology of microbes. "What these genomes have given us is amazing in terms of being able to look under the hood at the machine of these organisms that we never really knew anything about, except that we saw them in certain types of environments."

Wrighton, Banfield and colleagues at UC Berkeley, Lawrence Berkeley National Laboratory (LBNL), Oak Ridge National Laboratory (ORNL) and Pacific Northwest National Laboratory (PNNL), report their metagenomic analysis in the Sept. 28 issue of the journal Science. Banfield is also a member of the Earth Sciences Division at LBNL.

The metagenomic analysis proves that methods developed by Banfield at UC Berkeley to take a jumble of sequenced genes and assign them to specific microbes works even when there are nearly 100 bacteria and Archaea in the sample. Most metagenome analyses generally leave the genes unassigned to organisms, which gives scientists little idea of the role specific microbes play.

"The techniques developed in Jill's lab for doing metagenomics of very complex microbial communities is giving us a much more accurate look at what the microbes are doing and how we can modify them to get them to do more effectively what we want them to do, which is reduce uranium to form a solid," said Philip E. Long, an LBNL geologist who manages research at the Rifle study site. "We are finding out from these studies that the subsurface microbial economy is different from what we thought."

The "dark matter" of biology

The microbes came from groundwater samples taken at a site once used to process vanadium and, during and after World War II, uranium. The site borders the Colorado River, which means that rain can carry dissolved metals into the groundwater and eventually into the river. Some microbes "breathe" the metals like we breathe oxygen, chemically altering them so they become insoluble and remain in the sediment, Wrighton said.

Banfield refers to microbe communities like these as the "dark matter" of biology, an analogy to the missing mass in the universe that has stumped astronomers for decades. The bacterial tree of life can be divided into about 60 phylum-level branches, but essentially nothing is known about half of them, she said.

"This new study provides new knowledge about the ecology as well as the evolution of a significant chunk of what could be considered the dark matter of the microbial world," she said.

Before now, Banfield had performed metagenomic analyses of eight microbes coexisting in highly acidic underground streams in a former California mine and current Superfund clean-up site. Such an analysis involves grinding up all organisms in a sample, sequencing all the genes and then matching each with a unique microbial species.

The new study involved the genomes of 10 times more organisms. All are anaerobic ? they don't breathe oxygen like most organisms on Earth ? and most, while not new to science, are totally unstudied because they cannot be cultured in the laboratory. Many are only a few hundred nanometers across, making them among the smallest known microbes.

Scientists at the Rifle site spread acetate ? essentially dilute vinegar ? in the subsurface to feed the underground bacteria that convert soluble metals to insoluble metals. They had assumed that they were culturing a colony comprised mostly of Geobacter bemidjiensis, a well-known metal-reducing bacterium.

Instead, Wrighton said, analysis of three samples obtained within 10 days of acetate application showed a healthy population of Geobacter, but a throng of other bacteria presumably feeding on dead Geobacter and other carbon in the soil from previous additions of acetate. These organisms use or ferment complex carbon, such as dead plants and dead microbes, and produce hydrogen, small organic carbon compounds and carbon dioxide.

"The fermenters producing hydrogen after multiple additions of acetate may be more important to the underlying microbial community than we once thought," Long said.

"What we found was like a microbial zoo," Wrighton said. "We thought that the respiring organisms ? those breathing metals and making carbon dioxide ? were our heavy lifters, but we found that fermentative organisms probably underpin their metabolism. These organisms produce as a bi-product acetate, lactate and ethanol as well as hydrogen and those are all components that these respiring organisms can use."

Wrighton, Banfield and their team are continuing metagenomic analyses of samples from the Rifle site, including some obtained before nutrients are added to determine what the natural population looks like. This will provide a comprehensive view of the metabolic potential of the subsurface that ultimately can be harnessed for bioremediation, Banfield said.

"Our research has lifted a veil on a large portion of bacterial life and enabled us to probe in great depth and detail these unknown and uncultured bacteria," said Wrighton, who hopes to use this information to raise the microbes in the laboratory. "We now have information, which is encoded in their genomic DNA, pertaining to what they look like, how they make their living in the environment, and the interactions they have with other organisms."

Obama touts 'economic patriotism' in 2-minute ad

WASHINGTON (AP) ? President Barack Obama is pitching a broad economic argument to voters before next week's debate with Republican opponent Mitt Romney, buying TV time in seven battleground states to promote a "new economic patriotism."

In a two-minute ad, Obama looks into the camera as he promotes an economic plan he says will create 1 million manufacturing jobs, cut oil imports and hire thousands of new teachers.

The ad set to air in New Hampshire, Virginia, Florida, Ohio, Iowa, Nevada and Colorado comes as both men shadow each other while looking for votes in a closely contested race. It was not running in North Carolina, Wisconsin and Pennsylvania, underscoring the states where the president's campaign contends the election is truly being fought.

On Thursday, the two candidates are scheduled to campaign in the same state for the third straight day, this time in Virginia, a critical battleground in the Nov. 6 election. Romney is to appear in suburban Washington for a veterans' event, while Obama speaks in Virginia Beach.

The simultaneous visits follow an all-day duel Wednesday in Ohio, where Romney declared he can do more than Obama to improve the lives of average people. Obama scoffed that a challenger who calls half the nation "victims" was unlikely to be of much help.

Amid the hunt for working-class voters, Romney released a new ad Thursday aimed at coal miners. It included video of Obama as a candidate in 2008 saying he would support laws to force emitters of greenhouse gases to buy allowances at auction. "So if somebody wants to build a coal-powered plant, they can; it's just that it will bankrupt them," Obama says in the ad.

Romney spokeswoman Andrea Saul responded to Obama's two-minute ad by arguing that the GOP nominee can deliver a recovery, while Obama has mishandled the economy during his four years in office. "In the time it takes his latest ad to run, our national debt grows by at least another $5 million," Saul said in a statement.

Saul cited the Commerce Department's announcement Thursday of sluggish economic growth in the last quarter as evidence of Obama's economic failings. The growth rate was lowered from a previous estimate of 1.7 percent to 1.3 percent for the April-June quarter because of the severe drought that reduced farm production in the Midwest.

Meanwhile, new Republican-leaning independent groups have entered the presidential advertising fray as polling suggests Romney's campaign may be losing ground against Obama in key states such as Ohio and Florida.

The commercials, aimed at voters who supported Obama in 2008 but are now undecided, join those from the campaigns and outside groups swamping a narrow and possibly shrinking map of competitive states in the fast-moving presidential contest. Americans for Job Security launched an $8.7 million ad buy in six battleground states, while the Ending Spending Action Fund, a new conservative group bankrolled by billionaire Joe Ricketts, was set to debut a $10 million, four-state ad campaign on Thursday.

Polls show Obama widening his lead in several key states amid backlash from a leaked video in which Romney disparages the 47 percent of Americans who don't pay federal income tax as government-dependent Obama supporters who see themselves as victims and won't take responsibility for their own lives.

Obama's campaign was reveling in the latest public polling but trying to crush any sense of overconfidence. "If we need to pass out horse blinders to all of our staff, we will do that," campaign spokeswoman Jen Psaki said Wednesday.

Romney went after working-class voters at three stops in Ohio, while Obama rallied college crowds at Bowling Green and Kent State. Early voting in Ohio begins next week.

"If President Obama were to be re-elected, what you'd see is four more years like the last four years, and we can't afford another four more years like the last four years," Romney told a boisterous crowd in Toledo at his final stop on Wednesday.

Romney said the country had lost more than half a million manufacturing jobs in the past four years. "This is not the path we want for America," he said.

Romney's campaign has been reeling from his caught-on-video comments at a Florida fundraiser last May. New opinion polls, conducted after the video became public last week, show Obama opening up apparent leads in battleground states, including Ohio and Virginia.

Romney told ABC News that the race was in a statistical tie in some national polls.

"I'm very pleased with some polls, less so with other polls, but frankly at this early stage, polls go up, polls go down," he said.

Obama was not about to let the video comments fade away. He said Wednesday that "America is not about what can be done for us. It's about what can be done by us together, as one nation, as one people."

He added, "You can't make it happen if you write off half the nation before you take office."

Obama supporters also are working to keep Romney's "47 percent" comments alive. Democratic super PAC Priorities USA Action and a political group tied to the American Federation of State, County and Municipal Employees released a radio ad in Ohio and Virginia airing the remarks. The ad, part of a $1.25 million radio buy, tells listeners Romney's "just not looking out for us."

Obama flubbed a line at Kent State while building to his argument for keeping jobs in the United States. He mistakenly said, "I want to see us export more jobs." He quickly corrected himself, saying he meant to say "export more products."

"Excuse me," Obama said. "I was a channeling my opponent there for a second."

Personal Finance and Election Predictions

For a bit of election year fun, Credit Karma has done an analysis of credit behavior (credit scores and debt levels) on a red vs. blue state basis and then used the results to attempt to predict what will happen in the so-called swing states.

For those that are unaware, red states are those that are expected to vote Republican whereas blue states are expected to vote Democrat. All state definitions came from CNN and NY Times election maps.

In their analysis, they found that individuals from blue states have marginally higher credit scores (662 vs. 638) as well as credit card debt levels ($5,830 vs. $5,253) and student loan debts ($30,418 vs. $27.478*). They then ran the numbers for the eight swing states (below).

From this, they concluded that if ? and this is a HUGE if ? credit data can be used to predict voter behavior, then Colorado, Virginia, New Hampshire, and Iowa are likely to vote Democrat this year.

In fact, according to the excellent election polling site FiveThirtyEight, all four of these states are currently leaning to the blue side. That being said, so are Florida, Nevada, Ohio, and Wisconin?

What does this mean? Probably very little, but I thought it was a unique way to slice and dice the data. And it does get at a bigger question: to what extent does your personal financial situation influence your decisions in that voting booth?

I did find the apparent correlation between credit scores and debt levels intriguing, with blue states having both higher credit scores and higher debt levels. Looking at the swing state data, there?s likewise a slight positive association between credit scores and credit card debt levels (but no such pattern emerges for student loans).

The two main possibilities here are that credit score calculations favor those who are carrying higher debt levels or that those with higher credit scores are given higher credit limits. Either way, it?s disappointing to see so much being carried by so many people.

*Note: It wasn?t entirely clear to me how they calculated the student loan debt. These numbers are so high that they must have looked at average loan balance for those with loans, or something along those lines.

If we needed yet another reason to get up and start moving, here it is: a recent study conducted by researchers at the University of Wisconsin has revealed that regular exercise can reduce the occurrence of developing Age-Related Macular Degeneration (AMD). The researchers looked at other factors, such as age, weight and blood fat levels, determining that the participants who were physically active lowered their risk of developing AMD by as much as 70 percent compared to those who did very little exercise. They also found that those who walked regularly lowered their AMD risks by 30 percent.

Age-Related Macular Degeneration (ARMD) is a progressive sight-limiting condition affecting the macula, the small central area of the inner eye responsible our sharpest vision. According the National Institute of Health, Macular degeneration is the leading cause of blindness in Americans 60 and over.

Details of the Study The research project began in 1988, and approximately 4,000 men and women between the ages of 43 and 86 participated for more than 15 years. Researchers evaluated their exercise levels and performed eye tests at five year intervals. Published by the British Journal of Ophthalmology, the research study concentrated on the exercise habits and eye health of each participant. Once underway, researchers discovered that one out of four people led an active lifestyle, with one of out of four using a total of six flights of stairs daily.

The Benefits of Exercise on Eye Health Exercise is good for every cell in the human body, however, research studies have shown that exercise: Reduces macular degeneration risks caused by heart disease by lowering triglycerides and increasing HDL. Prevents 50 percent of Type 2 Diabetes cases by warding off vision loss from diabetic retinopathy.

Recommendations The National Health Service of the U.K. recommends people exercise at least 30 minutes daily, unless they lead a sedentary lifestyle; in those cases, they should exercise even more. The U.S. Department of Agriculture advises people to participate in at least 90 minutes a day of exercise. Barbara McLaughlan, who is an eye health consultant from the U.K. Royal National Institute of the Blind, said that research seems to verify that leading healthy lifestyles can do the eyes some good. She also mentions that people should still continue to have annual eye tests, considering that AMD has a strong genetic connection and early detection is crucial. The bottom line: We all need to get regular, daily exercise, avoid sedentary habits and find activities we enjoy doing, so we can stick to our exercise routines for the long run.

Milwaukee, WI (Northland's NewsCenter) --- President Obama is on the campaign trail in Wisconsin Saturday, just 45 days away from November's election.

Milwaukee mayor Tom Barrett and his wife, Kris, greeted the President as he arrived at the Milwaukee Theatre.

During a campaign speech there, the President criticized tax cuts under Republican Presidential Candidate Mitt Romney's plan.

He said Romney believes in top down economics and has proposed tax cuts skewed toward the wealthy.

Meanwhile, Obama pledged he would not slash investments and make young people pay more for college to pay for tax cuts for millionaires and billionaires.

He vowed that Medicare would not become a voucher program and that he would not turn Social Security over to Wall Street.

"Instead of giving tax breaks to companies that ship jobs overseas, we want to give tax breaks to companies that are investing in new plants, and equipment, and workers right here, in Milwaukee, right here in Wisconsin-right here, in the United States of America," President Obama said.

First Lady Michelle Obama will be in Appleton next week for a campaign appearance.

Presidential candidate Mitt Romney is campaigning in Florida.

A simple three-question paper-and-pencil survey, given to women in the doctor?s office in less than two minutes, can effectively identify those who are experiencing symptoms that may indicate ovarian cancer, according to a study by researchers at Fred Hutchinson Cancer Research Center. The study represents the first evaluation of an ovarian cancer symptom-screening tool in a primary care setting among normal-risk women as part of their routine medical-history assessment.

The results are published online in the Open Journal of Obstetrics and Gynecology.

Early detection of ovarian cancer is key to survival. Cure rates for those diagnosed when the disease is confined to the ovary are approximately 70 percent to 90 percent. However, more than 70 percent of women with ovarian cancer are diagnosed with advanced-stage disease, when the survival rate is only 20 percent to 30 percent.

The researchers evaluated the effectiveness and feasibility of several different symptom screening surveys.?

After a few tweaks to formatting and content, the version that proved most effective contained three questions that asked whether a woman was currently experiencing one or more of the following symptoms, all of which have been identified previously as potentially indicative of ovarian cancer:
? Abdominal and/or pelvic pain
? Feeling full quickly and/or unable to eat normally
? Abdominal bloating and/or increased abdomen size

The survey also asked about the frequency and duration of these symptoms: how many days a month and for how long?

?Symptoms such as pelvic pain and abdominal bloating may be a sign of ovarian cancer but they also can be caused by other conditions. What?s important is to determine whether they are current, of recent onset and occur frequently,? said lead author M. Robyn Andersen, Ph.D., a member of the Hutchinson Center?s Public Health Sciences Division. Previous research by Andersen and colleagues has found that about 60 percent of women with early-stage ovarian cancer and 80 percent of women with advanced disease report symptoms that follow this distinctive pattern at the time of diagnosis.

?Women with symptoms that are frequent, continual and new to them in the past year should talk to their doctor, as they may be candidates for further evaluation with ultrasound and blood tests that measure markers of ovarian cancer such as CA-125,? she said. ?Recent research indicates that approximately one in 140 women with symptoms may have ovarian cancer. Aggressive follow-up of these symptoms can lead to diagnosis when ovarian cancer can be caught earlier and more effectively treated.?

The study involved 1,200 women, age 40 to 87, who were seen in a Seattle women?s health clinic. More than half of the study participants reported being postmenopausal and approximately 90 percent were white. About half of the clinic visits were for a current health concern or for follow-up of a health problem reported at an earlier visit. The other half were for routine appointments such as mammography screening.

Of those surveyed, 5 percent had a positive symptom score that indicated the need for further testing. Of this group of about 60 women, one was diagnosed with ovarian cancer shortly thereafter. Of the 95 percent of women who tested negative on the symptom survey, none developed ovarian cancer during a 12-month follow-up period, which attests to the accuracy of the screening tool.

Those who reported current symptoms on the questionnaire or reported other medical concerns scored higher than those who did not. Non-white women were also about twice as likely to receive a positive symptom score as compared to white women.

?If ovarian cancer screening using symptoms is widely adopted, maximizing the specificity of screening programs will be important,? the authors wrote. ?Until better biomarkers are identified and tested, collecting information about symptoms appears to have promise.?
The bottom line, Andersen said, is that the screening tool can be used easily in a primary-care setting, is acceptable to patients and providers, and identifies women with symptoms that are worthy of concern with minimal false-positive results.

The study questionnaire that was tested in the clinic was based on a symptom-screening index developed in 2006 by Andersen and co-author Barbara Goff, M.D., professor and director of Gynecologic Oncology at the University of Washington School of Medicine.

Unfortunately, many powers of attorney are more general in nature and can actually cause more problems than they solve, especially for our senior population. This issue of the ElderCounselor e-newsletter is intended to highlight the benefits of a comprehensive, detailed power of attorney. A proper starting point is to emphasize that the proper use of a power of attorney as an estate planning and elder law document depends on the reliability and honesty of the appointed agent.

The agent under a power of attorney has traditionally been called an ?attorney-in-fact? or sometimes just ?attorney.? However, confusion over these terms has encouraged the terminology to change so more recent state statutes tend to use the label ?agent? for the person receiving power by the document.

The ?law of agency? governs the agent under a power of attorney. The law of agency is the body of statutes and common law court decisions built up over centuries that dictate how and to what degree an agent is authorized to act on behalf of the ?principal??the individual who has appointed the agent to represent him or her. Powers of attorney are a species of agency-creating document. In most states, powers of attorney can be and most often are unilateral contracts?that is, signed only by the principal, but accepted by the agent by the act of performance.

Much has been written about financial exploitation of individuals, particularly seniors and other vulnerable people, by people who take advantage of them through undue influence, hidden transactions, identity theft, and the like. A prior issue of the?ElderCounselor?addressed guardianships and conservatorships and discussed the benefits of court supervision of care of vulnerable people in such contexts. Even though exploitation risks exist, there are great benefits to one individual (the principal) privately empowering another person (the agent) to act on the principal?s behalf to perform certain financial functions.

A comprehensive power of attorney may include a grant of power for the agent to represent and advocate for the principal in regard to health care decisions. Such health care powers are more commonly addressed in a separate ?health care power of attorney,? which may be a distinct document or combined with other health topics in an ?advance health care directive.?

Another important preliminary consideration about powers of attorney is ?durability.? Powers of attorney are voluntary delegations of authority by the principal to the agent. The principal has not given up his or her own power to do these same functions but has granted legal authority to the agent to perform various tasks on the principal?s behalf. All states have adopted a ?durability? statute that allows principals to include in their powers of attorney a simple declaration that no power granted by the principal in this document will become invalid upon the subsequent mental incapacity of the principal. The result is a ?durable power of attorney??a document that continues to be valid until a stated termination date or event occurs, or the principal dies.

Having covered the explanation of what a durable power of attorney is, let?s look at the top 10 benefits of having a comprehensive durable power of attorney.

1. Provides the ability to choose who will make decisions for you (rather than a court).

If someone has signed a power of attorney and later becomes incapacitated and unable to make decisions, the agent named can step into the shoes of the incapacitated person and make important financial decisions. Without a power of attorney, a guardianship or conservatorship may need to be established, and can be very expensive.

2. Avoids the necessity of a guardianship or conservatorship. Someone who does not have a comprehensive power of attorney at the time they become incapacitated would have no alternative than to have someone else petition the court to appoint a guardian or conservator. The court will choose who is appointed to manage the financial and/or health affairs of the incapacitated person, and the court will continue to monitor the situation as long as the incapacitated person is alive. While not only a costly process, another detriment is the fact that the incapacitated person has no input on who will be appointed to serve.

3. Provides family members a good opportunity to discuss wishes and desires.

There is much thought and consideration that goes into the creation of a comprehensive power of attorney. One of the most important decisions is who will serve as the agent. When a parent or loved one makes the decision to sign a power of attorney, it is a good opportunity for the parent to discuss wishes and expectations with the family and, in particular, the person named as agent in the power of attorney.

4. The more comprehensive the power of attorney, the better.

As people age, their needs change and their power of attorney should reflect that. Seniors have concerns about long term care, applying for government benefits to pay for care, as well as choosing the proper care providers. Without allowing the agent to perform these tasks and more, precious time and money may be wasted.

5. Prevents questions about principal?s intent.

Many of us have read about court battles over a person?s intent once that person has become incapacitated. A well-drafted power of attorney, along with other health care directives, can eliminate the need for family members to argue or disagree over a loved one?s wishes. Once written down, this document is excellent evidence of their intent and is difficult to dispute.

6. Prevents delays in asset protection planning.

A comprehensive power of attorney should include all of the powers required to do effective asset protection planning. If the power of attorney does not include a specific power, it can greatly dampen the agent?s ability to complete the planning and could result in thousands of dollars lost. While some powers of attorney seem long, it is necessary to include all of the powers necessary to carry out proper planning.

7. Protects the agent from claims of financial abuse.

Comprehensive powers of attorney often allow the agent to make substantial gifts to self or others in order to carry out asset protection planning objectives. Without the power of attorney authorizing this, the agent (often a family member) could be at risk for financial abuse allegations.

8. Allows agents to talk to other agencies.

An agent under a power of attorney is often in the position of trying to reconcile bank charges, make arrangements for health care, engage professionals for services to be provided to the principal, and much more. Without a comprehensive power of attorney giving authority to the agent, many companies will refuse to disclose any information or provide services to the incapacitated person. This can result in a great deal of frustration on the part of the family, as well as lost time and money.

9. Allows an agent to perform planning and transactions to make the principal eligible for public benefits.

One could argue that transferring assets from the principal to others in order to make the principal eligible for public benefits?Medicaid and/or non-service-connected Veterans Administration benefits?is not in the best interests of the principal, but rather in the best interests of the transferees. In fact, one reason that a comprehensive durable power of attorney is essential in elder law is that a Judge may not be willing to authorize a conservator to protect assets for others while enhancing the ward/protected person?s eligibility for public benefits. However, that may have been the wish of the incapacitated person and one that would remain unfulfilled if a power of attorney were not in place.

10. Provides peace of mind for everyone involved.

Taking the time to sign a power of attorney lessens the burden on family members who would otherwise have to go to court to get authority for performing basic tasks, like writing a check or arranging for home health services. Knowing this has been taken care of in advance is of great comfort to families.
